The Honourable Rod Welford MP Attorney-General Minister for justice 5 February 2003 Mr W L Kelly 14 Lime street REDCLIFFE QLD 4020 Dear Mr Kelly You wrote to me in September last year following my previous correspondence the same month. I apologise for the delay in responding again but I must reiterate that there is nothing further I am able to do to address your particular grievance. The alternative course open to you, and any other person dissatisfied with the outcome of a Small Claims Tribunal hearing, is to appeal on legal grounds in accordance with the normal appeal processes. I acknowledge that you may not have done this in your case because you could not afford further legal action, however there is no obligation under any international conventions for government to provide free legal representation on appeals. In any event, as I indicated to you, I believe it is now too late to reopen your particular case. I agree with you it is now time for you to get on "with other aspects of our lives". I can confirm that I have discussed this matter with the Chief Magistrate and in discussions with other magistrates, they will be encouraged to be more sensitive to the needs of people with hearing impairment appearing in the Small Claims Tribunal. I trust this now finalises this matter for you, although I acknowledge that in the absence of rectifying the injustice you considered to have been done in your case, the outcome might not be entirely satisfactory.
